1. Introduction

Welcome to Magic Me. These Terms of Service ("Terms") govern your use of the Magic Me mobile application (the "App") operated by 01WW Technology Co., Ltd. ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use the App.

2. Use of the App

2.1 Content Guidelines

When using our App, you represent and warrant that:

• You own or have necessary rights to the content you upload

• Your content does not violate any third-party rights (including intellectual property rights)

• Your content complies with all applicable laws and regulations

• Your content is not harmful, offensive, or inappropriate

2.2 AI Generated Content

Regarding AI-generated content:

• The AI features are provided on an 'as is' and 'as available' basis

• We make no warranties regarding the quality, accuracy, or reliability of AI-generated content

• You are solely responsible for reviewing and verifying AI-generated content before use

• We reserve the right to modify or discontinue AI features at any time

2.3 Data Responsibility

You are responsible for:

• Maintaining the security of your account credentials

• All activities that occur under your account

• Creating and maintaining backups of your content

• Immediately notifying us of any unauthorized access to your account

3. Intellectual Property

3.1 User Content

You retain all rights to your original content. By uploading content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content solely for the purposes of providing, operating, developing, and improving our services. This license continues even if you stop using our services, solely with respect to content already uploaded.

3.2 AI Generated Content

Regarding AI-generated content:

• You receive a limited, non-exclusive, non-transferable license to use the generated content

• We retain all rights to our AI technology, models, and systems

• You are solely responsible for ensuring your use of generated content complies with applicable laws and does not infringe any third-party rights

• We make no representations or warranties about the accuracy, completeness, or appropriateness of AI-generated content

• We are not liable for any consequences resulting from your use of AI-generated content

4. Data Collection and Use

We use AppsFlyer, a third-party analytics service, to collect certain data for advertising and analytics purposes. This data may include device identifiers and advertising identifiers. For more information on how we collect, use, and protect your data, please refer to our Privacy Policy.

5. Prohibited Uses

You agree not to use the App:

• In any way that violates any applicable laws or regulations

• To impersonate or attempt to impersonate the company, a company employee, another user, or any other person or entity

• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the App

• For any fraudulent or unlawful purpose

6. Premium Features

6.1 Subscription Terms

Premium features are available through subscription or credit purchases. By subscribing:

• You authorize recurring payments at the then-current rates

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date

• Subscription fees are non-refundable except where required by law

• We reserve the right to change subscription fees upon reasonable notice

6.2 Refunds

Refund requests are handled according to the platform's (App Store/Google Play) policies.

7. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the App and delete your account.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 01WW TECHNOLOGY CO., LTD. AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP.

9. Changes to the Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by sending a notification within the App. Your continued use of the App after such modifications will constitute your acknowledgment and agreement to the modified Terms.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region ('Hong Kong'), without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms, including the validity, invalidity, breach or termination thereof, shall be settled through:

• First, through amicable negotiations in good faith

• If negotiations fail, through mediation in Hong Kong

• If mediation fails, through arbitration administered by the Hong Kong International Arbitration Centre under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted
